The 3 year regulatory transition period (October 26, 2020 to October 26, 2023) has now ended. As a result, regulated parties, including all manufacturers, importers, distributors and sellers of fertilizers and supplements must adhere to the amended Fertilizers Regulations. 1. Purpose

The purpose of this document is to outline labelling requirements for fertilizers and supplements regulated under the Fertilizers Act and regulations.

As defined in the Fertilizers Act, a package includes a sack, bag, barrel, case or any other container in which fertilizers or supplements are placed or packed.

2. General regulatory labelling requirements

Every person who packages, or causes to be packaged, a fertilizer or supplement, or who imports a packaged fertilizer or supplement, must ensure that the package is labelled in accordance with the Fertilizers Regulations.

All information required by the regulations must be printed conspicuously, legibly and indelibly in both English and French.

A product label must:

  • not include any incorrect or misleading information or symbol that could reasonably be expected to mislead a purchaser with respect to the identity of the product as a fertilizer or supplement, its safety, composition or directions for use
  • be consistent with all information provided to the Canadian Food Inspection Agency (CFIA) during the registration process (if applicable)
  • clearly define any acronyms used and
  • use metric units of measurement

    Equivalent imperial units are permitted to appear in addition to the metric (conversion must be accurate).

No changes may be made to the label, chemical composition or ingredients in a product that would impact its identity as a fertilizer or supplement, its safety, or its use, unless the registration is first amended accordingly.

Fertilizers or supplements packaged together in a multi-pack or kit are regulated as individual products and, as such, must be individually labelled in compliance with the Fertilizers Act and regulations. Additionally, the label of each product included in a multi-pack or kit is required to be visible, and legible to the consumer without opening the kit packaging. This requirement may be met through packaging the products in transparent material that permits a potential buyer to read the individual labels in their entirety, or the individual product labels must appear on the outer "kit" packaging.

3. Information required on a fertilizer or supplement label

Details on the information that is required to appear on the labels of fertilizers and supplements that are regulated under the Fertilizers Act are provided below (sample labels can be found in appendix 1). Some fertilizer and supplement product types have special labelling requirements that differentiate them from the general requirements in the regulations. These specific requirements are detailed in dedicated sub-sections of this labelling trade memorandum, or in separate trade memoranda for certain product-types. The following links will bring the reader directly to the appropriate product-specific labelling guidance:

  • fertilizer-pesticides
  • seeds treated with fertilizers or supplements
  • growing media containing fertilizers or supplements
  • customer-formula fertilizers
  • products consisting solely of peat, peat moss, sphagnum moss, coconut coir, tree bark, perlite or vermiculite

With the exception of the product types identified above, a package containing a fertilizer or a supplement must be labelled with the following:

3.1 Product identity and description

  • The name and complete address of the manufacturer or registrant or, if a fertilizer or supplement is not registered under the Fertilizer Regulations, the name and address of the person who packaged or caused the fertilizer or supplement to be packaged
  • The name of the fertilizer or supplement

    The name of a fertilizer that contains any major plant nutrient must include the grade designation that is stated as a hyphenated numerical series (the numerals must represent guarantees expressed in percent for total nitrogen, available phosphoric acid and soluble potash listed in that order). Note: a fertilizer that is intended for daily feeding and that is not intended for further dilution is not required to have its grade as part of its name

  • The weight of the fertilizer or supplement (volume is alsomay also be included in addition to weight permitted)
  • The lot number of the fertilizer or supplement

    Lot number means a combination of letters, or numbers, or both, that allows a lot of a fertilizer or supplement to be traced in manufacture and distribution

  • In the case of a product in which the active ingredient may deteriorate, the date beyond which the supplement is not intended for use
  • If the fertilizer or supplement is registered, its registration number
  • If the fertilizer or supplement product is exempt from registration because its ingredients appear on the List of primary fertilizer and supplement materials (list of materials), the term (name) for each component, as it appears on the list of materials, and any other information that is sufficient to demonstrate that the fertilizer or supplement is exempt
  • If the fertilizer is exempt from registration but the ingredients do not appear on the list of materials, the name of each component

    This information may be represented as an active ingredient derivation statement which lists all the ingredients.

  • For mixtures of exempt fertilizers and supplements, or registered fertilizers and supplements, or mixtures of registered and exempt products:
    • Option A: label demonstrates exemption
      • the registration number of each registered fertilizer or supplement product
      • the term (name) of each component as it appears on the list of materials and
      • any other information that demonstrates the fertilizer or supplement is exempt (for example, sources of nutrients that do not appear on the list of materials but that are not produced by or derived from a living organism)

      This information may be presented as an active ingredient derivation statement which lists all relevant terms from the list of materials, Fertilizers Act registration numbers and/or all other exempt sources for nutrients in the guaranteed analysis, as applicable. For example, "active ingredients derived from humic acid and registered product: xxxxxxxF Fertilizers Act." When provided, the active ingredient derivation statement should appear directly below the Guaranteed analysis.

    • Option B: record keeping

      Alternatively, a fertilizer or supplement product can be labelled with a statement indicating that any fertilizers or supplements in the mixture are registered or exempt from registration, and the responsible party maintains records of any information necessary to demonstrate that the final mixture is exempt from registration for a period that extends 5 years beyond any import or sale of the product, and informs the CFIA of where they are kept. Please refer to T-4-131 for detailed record keeping requirements. Note: option B is not available for growing media and seed products.

3.2 Guaranteed analysis

The guaranteed analysis of a fertilizer or supplement must include, if applicable:

Nutrients

Untreated phosphatic fertilizer means a fertilizer whose sources of phosphorus have not been treated to increase the water solubility of the phosphorus therein.

  • the minimum amount of total nitrogen, available phosphoric acid and soluble potash, expressed in percent
  • in the case of an untreated phosphatic fertilizer (represented to contain phosphorus), the minimum amount of total phosphoric acid and the minimum amount of available phosphoric acid, expressed in percent

    Examples of untreated phosphatic fertilizers include rock phosphate, struvite or magnesium ammonium phosphate, compost, manure and municipal biosolids.

  • the minimum amount of each secondary nutrient (calcium, magnesium or sulphur), expressed in percent on an elemental basis
  • the actual amount of each micronutrient (boron, chlorine, copper, iron, manganese, molybdenum or zinc), expressed in percent on an elemental basis

Microorganisms

  • active microorganisms (except in the case of consortia) must each be listed by genus and species (and strain if available) along with the following information:
    • minimum number of viable cells per gram, or
    • for each microorganism that is not a viable cell, another descriptor of the minimum concentration of that microorganism on a per gram basis
  • for microbial consortia: a descriptor of the concentration of viable microorganisms on a per gram basis

pH adjusters

  • for active ingredient(s) intended to neutralize acidity:
    • the amount of calcium and magnesium, if any, expressed in percent on an elemental basis (minimum or actual)
    • its neutralizing value, expressed in percent of the acid neutralizing capacity of calcium carbonate (minimum or actual) and
    • the range of particle sizes of solid materials
  • where an active ingredient is an acidifying material intended to increase the hydrogen ion concentration of a growing medium: its acidifying value, expressed in percent of the basic neutralizing capacity of hydrochloric acid (minimum or actual)

Other active ingredients

Organic matter means the matter remaining after removal of the moisture and total ash fractions from substances derived from living organisms

  • organic matter: the amount expressed in percent and the moisture content expressed in percent (minimum or actual) and
  • any other active ingredient expressed in percent (minimum or actual)

Note: if the active ingredient to be expressed in percent, is present in a concentration of less than0.001%, the guaranteed analysis may instead indicate its concentration, on a per gram basis, using another unit of measure.

Mixtures containing registered or exempt products

For all registered or exempt products included in a mixture, guarantees for nutrients and active ingredients must be carried forward and appear on the mixed product's label. When present at very low quantities in the mixture, the requirement to guarantee these nutrients or other active ingredients is based on whether or not they are "active" in the final product.

Nutrients are no longer "active" (no longer a significant source of plant nutrients) when they can not be detected by standard laboratory analysis. Nutrients at these levels are therefore no longer "active ingredients" (an ingredient of a fertilizer or supplement to which its performance as a fertilizer or supplement is attributed) and should not appear in a final product's guaranteed analysis.

Similarly, when supplement active ingredients are diluted below the level at which they affect the performance of the product as a fertilizer or supplement, they are no longer active ingredients and should not appear in a final guaranteed analysis.

Labelling the guaranteed analysis section

The guaranteed analysis section may be entitled "Guaranteed minimum analysis" or "Guaranteed analysis". If the section's title includes "minimum", then any actives guaranteed on an actual basis (such as micronutrients) must include "(actual)" next to the guarantee. If the section's title does not specify minimum, then all guarantees are assumed to be actual amounts. Any actives guaranteed on minimum amount under such a heading must specify "(minimum)" (such as major plant nutrients).

3.3 Directions for use

For a fertilizer, the directions for use must include 1 of the following:

  1. complete recommendations, including the intended crop type, the rate, the frequency, and the timing of application; or
  2. if the product is only intended for use as a supply of nutrients in mixed products, a statement such as "only to be used as a source of nutrients for the production of fertilizers and growing media" is included on the label and include the intended downstream uses (for example, for use in fertilizer mixtures intended for foliar application on ornamental and edible crops); or
  3. a statement indicating that the user should seek the advice of the county agricultural representative or a professional agricultural consultant

Additionally, for all products that contain micronutrients intended to treat a specific nutrient deficiency, a statement must also appear on the label indicating that the product should be used on the basis of a soil and/or tissue analysis.

For a supplement, the complete directions for use are to appear on the product label and include: the intended plant/crop type, the rate, the frequency of application, and the timing of use. If applicable, dilution instructions.

For mixtures of exempt fertilizers and supplements, or registered fertilizers and supplements, or mixtures of registered and exempt products, directions for use of the mixture must be consistent with those of each registered product (for example, target crop, use pattern, application rate, frequency and method). The following chart lists of examples of consistent and inconsistent directions for use.

3.4 Claims

Environmental safety claims made on the label of a fertilizer or supplement product (for example: reduced nitrogen leaching, volatilization or runoff) require substantiation. Applicants may provide primary data and/or reference peer-reviewed literature to demonstrate that the active ingredient(s) can function as claimed, when used as intended.

3.5 Precautionary statements

A statement setting out any precaution that is necessary to mitigate a risk of harm to human, animal or plant health or the environment (except pests) may be required on the label/package of any regulated fertilizer or supplement product. Table 1 and 2 outline precautionary statements that are required when certain ingredients are present in a fertilizer or supplement product. In addition to the statements below, additional product-specific precautionary statements may be required on a case-by-case basis depending on the ingredients in the product, the product's risk profile and its intended use pattern.

Prohibited material as defined in subsection162(1) of the Health of Animals Regulations

  • feeding the fertilizer or supplement to cattle, sheep, deer or other ruminants is prohibited and punishable under the Health of Animals Act
  • the fertilizer or supplement is not to be used on pasture land or other grazing areas for ruminants
  • the fertilizer or supplement is not to be ingested, and
  • a person must wash their hands after they use the fertilizer or supplement

4. Disclosure of harmful ingredients

If any person requests a document in English or French that lists the ingredients that are contained in a fertilizer or supplement that present a risk of harm to the health of any human or animal and that do not appear on the label, the document must be provided by:

  • the person who packaged the fertilizer or supplement or caused it to be packaged; or
  • in the case of an imported fertilizer or supplement, the person who imported it

5. Customer formula fertilizers

Customer formula fertilizer means a fertilizer prepared in accordance with a written formula that sets out the name, amount and guaranteed analysis of each active ingredient and the signature of the person for whose use for fertilizing purposes it has been prepared.

A package containing a customer formula fertilizer that has intentionally incorporated in it, or is represented to contain a micronutrient, or pesticide or supplement shall be labelled with:

  • the name and address of the manufacturer of the fertilizer
  • a statement identifying any precaution that is necessary to mitigate a risk of harm to human, animal or plant health or the environment (other than pests)
  • the lot number of the fertilizer
  • the guaranteed analysis
    • in the case of a fertilizer containing a pesticide, the guaranteed analysis shall include the name and concentration of each active ingredient of any pesticide, expressed in percent
  • directions for use, if the fertilizer contains a pesticide
  • where the fertilizer contains a supplement, the registration number or term from the List of Materials that the ingredient meets
  • the name and address of the person who is to use the fertilizer; and
  • the weight of the fertilizer

A package containing a customer formula fertilizer that does not have intentionally incorporated in it, and is not represented to contain a micronutrient, or pesticide, shall be labelled with:

  • the name and address of the manufacturer of the fertilizer and the name of the person who is to use the fertilizer
  • a statement identifying any precaution that is necessary to mitigate a risk of harm to human, animal or plant health, or the environment
  • the lot number of the fertilizer
  • the guaranteed analysis and
  • the weight of the lot or shipment

6. Products consisting solely of peat, peat moss, sphagnum moss, coconut coir, tree bark, perlite or vermiculite

For products consisting solely of peat, peat moss, sphagnum moss, coconut coir, tree bark, perlite or vermiculite, as those terms are defined in the list of materials, or any combination of those materials, the package is required to be labelled with:

  • a statement indicating which of those materials are present in the fertilizer or supplement, and their proportions
  • the name and address of the person who packaged the fertilizer or supplement or caused it to be packaged
  • the name of the fertilizer or supplement
  • the volume or the weight of the fertilizer or supplement
  • the lot number of the fertilizer or supplement and
  • a statement setting out any precaution that is necessary to mitigate a risk of harm to human, animal or plant health, or the environment

Directions for use:
this product is recommended for correction of iron deficiencies in field crops of corn, snap beans, and onions. This product must only be used for corrections of deficiencies as determined by foliar and soil testing.

Apply at the rate of 0.8 to 2.5 kg per hectare. Depending on the deficiency, 1 application every 5 years to the soil is sufficient. For specific enquiries, consult an agricultural representative.

Caution: this fertilizer contains iron and should be used only as recommended. It may prove harmful when misused.

Pre-emergence inhibition of large and smooth crabgrass, white clover and dandelion seed germination in residential lawns where established perennial ryegrass or established Kentucky bluegrass are the predominant grass species.

Application rates and direction for use:
9.5 kg / 100m2

May inhibit weed seed germination when used in conjunction with a sound lawn (or turf) maintenance program.
Established weeds at time of application will not be inhibited. Do not apply the product on newly seeded grass as it may inhibit seeds from germinating, wait until after first mowing when root systems are established.
If over-seeding or re-sodding in the spring, do not apply the product in the spring. If over-seeding or re-sodding in the fall, do not apply the product in the fall.
For best results: apply to established turf twice a year; once in the early spring 2 weeks before weed seed germination, and once in the late summer or early fall after heat stress has passed.
Apply when soil is moist and when rain is forecasted within 2 days of treatment. If rainfall does not occur within 2 days of treatment, irrigation is required.
Excessive moisture at time of treatment may reduce the effectiveness of the product.

Les mauvaises herbes établies au moment de l'application ne seront pas inhibées. Ne pas appliquer le produit sur de l'herbe récemment semée, car il pourrait empêcher la germination des graines. Attendre après la première tonte que les racines soient bien établies.
